In compliance with article 10 of Law 34/2002, of 11 July, on Information Society Services and Electronic Commerce (LSSI-CE), the following sets out the identifying information of the owner of the website and the general terms of its use.

2. Purpose

Counterdeck (hereinafter, «the site» or «the platform») is a suite of online tools for the community of the Magic: The Gathering collectible card game, which includes, among other features, a deck builder, card browsing, a game simulator, a forum, auxiliary tools and an artificial intelligence assistant.

This Legal Notice governs the general terms of access and use of the site. Use of the site confers the status of user and implies full acceptance of all the terms set out here, as well as of the Privacy policy and the Cookie policy.

3. Terms of use

The user agrees to make appropriate use of the content and services and not to use them to:

• Disseminate unlawful, violent, pornographic, racist or xenophobic content, content that condones terrorism, that violates human rights or, in general, that is contrary to the law, public morals or public order.
• Introduce computer viruses, defective files or any other software that may cause damage to or alterations of the systems of the owner or of third parties.
• Carry out unauthorized advertising, promotional or commercial exploitation activities, in particular the mass sending of unsolicited messages.
• Gain unauthorized access to any section of the site, to other systems or networks connected to it, to equipment or services accessible over the internet, or to user accounts other than your own.
• Attempt to circumvent the security or authentication measures, reverse-engineer the site's code or automate the mass consumption of its resources (unauthorized scraping, abuse of the artificial intelligence APIs, etc.).

Failure to comply with any of these terms may lead to the suspension or cancellation of the user's account, without prejudice to any applicable legal action.

4. User registration and accounts

Certain features require registration through a third party's authentication service (Clerk Inc.). The user is responsible for the accuracy of the data provided and for safeguarding their access credentials. The owner may suspend or close accounts that breach these terms, that show a persistently negative credit balance or that are used to defraud the credit or referral system.

5. Intellectual and industrial property

The texts, designs, brand, logo, original source code, proprietary databases and other elements of the site are the property of Raúl Bumar or of the corresponding licensors and are protected by intellectual and industrial property law. Their reproduction, distribution, public communication or transformation without express authorization is prohibited.

The site incorporates third-party data and materials under compatible licenses, in particular:

• Magic: The Gathering, the card names, their mechanics, illustrations and other related materials, are the property of Wizards of the Coast LLC. Counterdeck is unofficial fan content permitted under the Wizards of the Coast Fan Content Policy. The site is not approved or endorsed by Wizards of the Coast.
• Card data and prices obtained from the public Scryfall API in accordance with its terms of use.
• Mana symbol iconography from the «Mana» font by Andrew Gioia, under the SIL Open Font License.

6. Payment services and credits

Certain features of the site (AI assistant, Premium subscription) operate with a system of virtual credits that can be purchased. The purchase is processed through external payment providers. Credits are not redeemable for money or transferable between accounts. The specific terms of each product are shown at the time of purchase.

7. Exclusion of warranties and liability

The owner does not guarantee the continuous and uninterrupted availability of the site. To the extent permitted by applicable law, damages arising from the following are excluded:

• Interruptions, failures or outages of the service.
• Errors or omissions in the content.
• Decisions about gameplay, trading or buying and selling that users make based on information provided by the site or by the artificial intelligence assistant. The information provided by the assistant may be inaccurate or out of date; the official rules of the game are those published by Wizards of the Coast.
• Content published by users in the forum or other community spaces, for which responsibility lies exclusively with the author of the publication.

8. Links to third-party sites

The site may contain links to external pages (Scryfall, Wizards of the Coast, Discord, GitHub and others). The owner is not responsible for the content or the privacy policies of those pages.

9. Modification of the legal notice

The owner reserves the right to modify these terms at any time. Modifications will take effect from their publication on the site. Users are advised to review this notice periodically.

10. Applicable law and jurisdiction

These terms are governed by Spanish law. For the resolution of any dispute, the parties submit to the Courts and Tribunals of the user's domicile when the user has the status of consumer; otherwise, to the Courts and Tribunals corresponding to the domicile of the owner of the site.
